These Terms and Conditions govern your access to and use of the Panda Dairy website, mobile web application, products and delivery services operated by Panda Dairy Products Private Limited, hereinafter referred to as “Panda Dairy”, “Company”, “we”, “us” or “our”.

By accessing the website, registering an account, adding products to the cart, placing an order or making a payment, you confirm that you have read, understood and agreed to these Terms and Conditions, our Privacy Policy, Refund and Cancellation Policy and Shipping and Delivery Policy.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to place an order. A person below 18 years of age may use the website only under the supervision of a parent or legal guardian.

2. Customer Account

You may be required to create or access a customer account using your email address, mobile number, OTP or other authentication method provided on the website.

You are responsible for:

  • Providing complete and accurate registration information.
  • Keeping your login credentials and OTP confidential.
  • All activity performed through your account.
  • Informing us immediately if you suspect unauthorised use of your account.

We may suspend or restrict an account if we reasonably believe that it is being misused, used fraudulently or used in violation of these Terms.

3. Products

Panda Dairy offers dairy and related food products including milk, curd, buttermilk, paneer, ghee, sweets, flavoured milk and other products displayed on the website.

Product images are provided for representation purposes. Actual packaging, label design, colour, appearance or batch information may vary without affecting the essential nature or quality of the product.

Customers must read the product label, ingredients, allergen information, storage instructions, manufacturing date, expiry or best-before date before consuming a product.

Customers with allergies, medical conditions or dietary restrictions are responsible for reviewing the product information and obtaining appropriate professional advice before consumption.

4. Product Availability

All products are subject to availability at the applicable fulfilment location or delivery hub.

Adding a product to the cart does not reserve stock. If a product becomes unavailable after an order is placed, we may:

  • Contact the customer and offer an alternative product.
  • Remove the unavailable product from the order.
  • Provide a partial refund for the unavailable product.
  • Cancel the affected order and provide an applicable refund.

No substitute product will be charged at a higher price without the customer’s consent.

5. Pricing, Taxes and Charges

Product prices displayed on the website are in Indian Rupees and may be revised from time to time.

The final amount payable, including applicable taxes, delivery charges, handling charges, discounts and other charges, will be displayed before the customer confirms payment.

In case of an obvious pricing or technical error, we may cancel the affected order and refund the amount paid by the customer.

6. Offers and Discounts

Offers, promotional codes and discounts may be subject to separate conditions including validity period, minimum order value, eligible products and usage limits.

Promotional benefits cannot be exchanged for cash and may be withdrawn where misuse, fraud or technical error is identified.

7. Order Placement and Acceptance

An order placed through the website is a request to purchase the selected products. An order is treated as accepted after payment confirmation and successful processing by Panda Dairy.

We reserve the right to reject or cancel an order for reasons including:

  • Product or stock unavailability.
  • Incorrect product price or description.
  • Delivery location outside the serviceable area.
  • Incorrect or incomplete customer information.
  • Payment failure or suspected fraudulent transaction.
  • Operational, safety or regulatory reasons.
  • Events beyond our reasonable control.

If a prepaid order is cancelled by us, the eligible amount will be refunded to the original payment method.

8. Payments

Online payments may be processed through Razorpay or another authorised payment service provider displayed during checkout.

Depending on availability, supported payment methods may include UPI, cards, net banking, wallets or other payment methods enabled by the payment service provider.

Payment availability and payment authentication are controlled by the issuing bank, UPI application, payment network and payment service provider.

Panda Dairy does not ask customers to disclose their UPI PIN, card PIN, CVV, net-banking password or OTP to our employees or delivery personnel.

9. Delivery Serviceability

Delivery is available only to locations marked as serviceable by the website.

Serviceability may be determined using the customer’s address, city, PIN code, selected map location, latitude and longitude and distance from the applicable delivery hub.

A previously serviceable location may become temporarily unavailable due to stock, weather, traffic, regulatory, operational or delivery capacity restrictions.

10. Customer Address and Map Location

The customer must provide a complete and accurate address, including house or flat number, street, locality, landmark, city, state, PIN code and map location wherever requested.

The delivery agent may use the address, map pin and contact number supplied by the customer to complete delivery.

Panda Dairy will not be responsible for delays or failed delivery caused by an incorrect address, incorrect map pin, unreachable phone number, restricted premises or absence of an authorised recipient.

11. Delivery and Inspection

The customer or an authorised recipient should be available at the delivery address during the estimated delivery period.

Customers should check the package at delivery for visible leakage, damage, broken seals, wrong products or missing products.

Any such issue must be reported according to the Refund and Cancellation Policy.

12. Storage and Consumption

Dairy products are perishable and temperature sensitive. Customers must follow the storage instructions printed on the product and refrigerate chilled products promptly after delivery.

Panda Dairy is not responsible for deterioration caused by improper handling or storage after successful delivery.

Products should not be consumed after the expiry or best-before date displayed on the packaging.

13. Cancellation and Refunds

Order cancellation, replacement and refund requests are governed by our Refund and Cancellation Policy, which forms part of these Terms.

Because dairy products are perishable, change-of-mind returns are generally not accepted after delivery.

14. Prohibited Activities

You must not:

  • Use the website for unlawful or fraudulent purposes.
  • Provide false customer, address or payment information.
  • Attempt unauthorised access to the website or another account.
  • Interfere with website security or normal operation.
  • Copy, scrape or commercially exploit website content.
  • Misuse refund, promotion, OTP or payment facilities.
  • Threaten, abuse or harass our staff, customer-support personnel or delivery agents.

15. Intellectual Property

The Panda Dairy name, logos, product photographs, website design, text, graphics, software and other content are owned by or licensed to Panda Dairy Products Private Limited.

No content may be copied, reproduced, modified, republished or commercially used without prior written permission.

16. Third-party Services

The website may use third-party services such as payment gateways, map providers, hosting providers, messaging services and delivery-support services.

Use of those services may also be subject to the respective provider’s terms and policies.

17. Limitation of Liability

To the extent permitted by applicable law, Panda Dairy will not be liable for indirect, incidental or consequential loss arising from:

  • Temporary website or payment-service interruption.
  • Customer-provided incorrect information.
  • Improper product storage after delivery.
  • Unauthorised customer-account use.
  • Events beyond our reasonable control.

Nothing in these Terms excludes any consumer right that cannot legally be excluded.

18. Force Majeure

We will not be responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, severe weather, floods, strikes, transport disruption, epidemic, government restrictions, power failure, internet failure or payment-network disruption.

19. Changes to These Terms

We may revise these Terms when required. The revised version will be published on this page with an updated effective date.

Continued use of the website after publication of revised Terms constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection law, disputes shall be subject to the jurisdiction of the competent courts in Vijayawada, Andhra Pradesh.
